Thanks for using our products and services ("Services"). The Services are provided by Habits & Co. DBA ("Union Photo Co.").
By using our Services, you are agreeing to these terms. Please read them carefully.
Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services.
1. Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of Union Photo Co. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Union Photo Co.
2. Use of Services
You agree to use our Services only for purposes as permitted by these Terms and any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions. You may only use the Services for non-commercial purposes.
3. Pricing and Payment
Pricing for our Services is clearly stated on our website. All payments are due upon receipt. If a payment is not received or the payment method is declined, the client forfeits the services provided by us.
4. Refund Policy
In the event of cancellation, deposits are non-refundable. Any additional funds paid may be refundable depending on the circumstances of the cancellation and at the sole discretion of Union Photo Co.
5. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
6. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.
7. Liability
In no event shall Union Photo Co., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Indemnification
You agree to defend, indemnify and hold harmless Union Photo Co. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms.
